What is the National Commission for SCs?

The National Commission for Scheduled Castes (NCSC) is a constitutional body established under Article 338 of the Indian Constitution. It is tasked with safeguarding the rights of Scheduled Castes (SCs). It investigates and monitors all matters relating to the safeguards provided for SCs.

Evolution of NCSC

  • The NCSC's origins can be traced back to the Indian Constitution. It initially established the position of a Special Officer under Article 338. 
  • This Special Officer was known as the Commissioner for Scheduled Castes and Scheduled Tribes. The officer was tasked with safeguarding the interests of these marginalized communities.
  • In 1987, the government decided to transform the single-member Commissioner system into a multi-member commission. 
  • The National Commission for Scheduled Castes and Scheduled Tribes (NCSCST) was then formed through the 65th Constitutional Amendment in 1990. The NCSCST comprised five members, along with a Chairman and Vice-Chairman.
  • However, the 89th Constitutional Amendment of 2003 brought about a significant change. It replaced the NCSCST with two separate commissions: 
    • the NCSC and 
    • the National Commission for Scheduled Tribes (NCST). 
  • This decision reflected the growing recognition of the distinct needs and challenges faced by SCs and STs.
  • The inaugural NCSC was formed in 2004 under the leadership of Suraj Bhan, marking a new chapter in the organization's history. 
  • Since then, the NCSC has continued to play a crucial role in advocating for the rights and welfare of Scheduled Castes across India.

The national commission for scheduled caste consists of-

  • a chairperson,
  • a vice-chairperson, and
  • three other members appointed by the President.

Constitutional Framework for the Upliftment of the Scheduled Caste

The Constitution of India meticulously outlines a framework for the advancement of Scheduled Castes (SCs).

  • Article 17 abolishes the practice of untouchability, eradicating social discrimination against SCs.
  • Article 46 mandates the state to promote the educational and economic interests of the weaker sections. It mandates it to protect them from social injustice and all forms of exploitation.
  • Article 335 stipulates that the representation of SCs and STs in public services should be commensurate with their population size.
  • Article 15(4) outlines specific provisions for the advancement of SCs and STs in education.
  • Article 16(4A) of the Constitution provides for reservation in promotions for SCs and STs who are underrepresented in the state services.
  • Article 338 establishes the National Commission for Scheduled Castes (NCSC) and Scheduled Tribes (NCST). These are tasked with monitoring matters related to their welfare.
  • Articles 330 and 332 of the Constitution reserve seats for SCs and STs in the Lok Sabha and state legislative assemblies, respectively.
  • Part IX of the Constitution deals with Panchayats (village councils), and Part IX(A)deals with Municipalities. These provide for reservation for SCs and STs in local bodies.
