Introduction of Vijaysinh Chandubha Jadeja vs State of Gujarat

The case of Vijaysinh Chandubha Jadeja vs State of Gujarat (2010) focuses on the different interpretations of Section 50 of the NDPS Act, 1985. Section 50 of the Act requires officers to inform an accused of their right to be searched in front of a Gazetted Officer or Magistrate. Earlier precedents like Joseph Fernandez vs State of Goa and Prabha Shankar Dubey vs State of M.P. held that simply asking the accused if they want such a search was enough. However, in Krishna Kanwar vs State of Rajasthan, the Supreme Court stressed that suspects must be fully aware of their rights. The issue was resolved in the Vijaysinh Chandubha Jadeja case where the Supreme Court held that it is mandatory for officers to inform accused of their right.
