Kamla Singh

Similarly, Kamla Singh was charged with an offence under Section 302 of the Indian Penal Code. He was acquitted in 1954 on grounds of insanity but he was declared sane in 1979. He remained in detention for four more years due to delay in the administrative process.

Hira Lai

Lastly, Hira Lai was detained in 1948 under Section 302 of the Indian Penal Code. Hira Lai was found to be insane during the trial. He was declared sane prior to December 1981 but he was continued to be detained until the intervention of the Court.

In each of the cases, prison authorities and government officials failed to take steps for the release of these prisoners despite medical reports and recommendations declaring them fit for release.
