Historical Context and Facts of Jagmohan vs State of UP 

The case revolves around the murder of Shivraj Singh i.e., the father of Jagbir Singh, a cousin of the Appellant. Shivraj Singh was murdered several years before the murder of Chhotey Singh. 

Acquittal

Chhotey Singh was initially charged with the murder of Shivraj Singh but was acquitted by the High Court. 

Feeling of enmity

After the acquittal of Chhotey Singh, enmity developed between Chhotey Singh and the Appellant along with Jagbir Singh who were both minors at the time of murder of Shivraj Singh.

Murder of Chhotey Singh

On September 10, 1969 Chhotey Singh was murdered. A day prior, there was a quarrel between him and Jagmohan Singh (Appellant’s associate) regarding irrigation rights which was settled without escalation. 

Incident of Murder

On the day of the murder, the Appellant armed with a country-made pistol and Jagbir Singh armed with a lathi ambushed Chhotey Singh as he walked to his field. The Appellant confronted him prompting Chhotey Singh to flee. The Appellant chased him and shot him in the back which resulted in the death of Chhotey Singh.

Decision of the Session Judge

The Sessions Judge after observing the facts and circumstances of the case the Appellant was sentenced to death. 

Appeal in the High Court

Aggrieved by the decision of the Session Judge the Appellant filed an appeal in the High court of Allahabad. However, the High Court upheld the decision of the Session Judge and asserted that there were no mitigating circumstances and that the punishment was just and appropriate.

Special Leave Petition

The Appellant approached the Supreme Court by filing a Special Leave Petition challenging the decisions of the High Court of Allahabad and Session Court, Shahjahanpur judgement.

Article 14 of the Indian Constitution

Article 14 states that the State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth.

Article 19 of the Indian Constitution

Article 19 states that- All citizens shall have the right-

  • to freedom of speech and expression
  • to assemble peaceably and without arms
  • to form associations or unions
  • to move freely throughout the territory of India
  • to reside and settle in any part of the territory of India
  • to practise any profession, or to carry on any occupation, trade or business

Article 21 of the Indian Constitution

Article 21 guarantees that no person shall be deprived of his life or personal liberty except according to procedure established by law.

Section 302 of the Indian Penal Code, 1860

Section 302 IPC provides punishment for murder. It states that whoever commits murder shall be punished with death or imprisonment for life and shall also be liable to fine.

Section 306(2) of the Criminal Procedure Code, 1973

Section 306(2) of the Code specifies the authority of the Magistrate to grant a pardon in exchange for the wrongdoer providing complete and clear information about the crime.

Section 309(2) of the Criminal Procedure Code, 1973

Section 309(2) of the Code allows the court to postpone or adjourn an inquiry or trial if it considers necessary. This power is exercised at the discretion of the Court and requires the court to record its reasons for the decision. The court may also impose terms and conditions and remand the accused to custody but only for a maximum of 15 days at a time.

Judgment and Impact of Jagmohan vs State of UP 

After analysing the facts and circumstances of the case, the five-judge bench unanimously upheld the constitutional validity of capital punishment. It held that it does not violate Articles 14, 19 and 21 of the Indian Constitution.

The bench clarified that Article 19 addresses freedoms such as speech, expression and trade but does not explicitly address the right to life. The right to live is fundamental to all other freedoms and it is subjected to reasonable restrictions in the interest of the public. The provision for capital punishment under Section 302 IPC meets these criteria and aligns with constitutional validity. The framers of the Constitution must have recognized the legal acceptance of capital punishment before incorporating provisions for pardon, suspension, remission, or commutation in Articles 72 and 134. Therefore, the death penalty cannot be deemed unreasonable or unconstitutional. The Court highlighted that each case should be individually assessed based on its specific circumstances and severity. Thus, the Appeal was dismissed by the Supreme Court.
