Interpretation of Article 68 of Indian Constitution

Article 68 of the Constitution states - “1) An election to fill a vacancy caused by the expiration of the term of office of Vice-President shall be completed before the expiration of the term.

2) An election to fill a vacancy in the office of Vice-President occurring by reason of his death, resignation or removal, or otherwise shall be held as soon as possible after the occurrence of the vacancy, and the person elected to fill the vacancy shall, subject to the provisions of article 67, be entitled to hold office for the full term of five years from the date on which he enters upon his office.”

Article 68 provides that an election must be held within six months from the date of the vacancy if the office of the Vice-President becomes vacant. It ensures that the position is not left unfilled for a long period and allows the government to function smoothly without disruption.

According to Article 67 of Indian Constitution, the Vice-President shall hold an office for a term of 5 years commencing from the date they assume office. It is important to note that if someone is elected to fill a casual vacancy in the office of the Vice-President they will serve for the remainder of the original term of the Vice-President.
