Article 111 of Indian Constitution deals with the assent to bills. It outlines the procedure for the President’s assent to Bills passed by Parliament. After a Bill is approved by both Houses, it is presented to the President who can either approve it withholding assent or return it for reconsideration. The provision plays an important role in the Constitution of India.

Interpretation of Article 111 of Indian Constitution

Article 111 of the Constitution states -When a Bill has been passed by the Houses of Parliament, it shall be presented to the President and the President shall declare either that he assents to the Bill, or that he withholds assent therefrom: Provided that the President may, as soon as possible after the presentation to him of a Bill for assent, return the Bill if it is not a Money Bill to the Houses with a message requesting that they will reconsider the Bill or any specified provisions thereof and, in particular, will consider the desirability of introducing any such amendments as he may recommend in his message, and when a Bill is so returned, the Houses shall reconsider the Bill accordingly, and if the Bill is passed again by the Houses with or without amendment and presented to the President for assent, the President shall not withhold assent therefrom.”

According to Article 111 of the Indian Constitution once a Bill is passed by both Houses of Parliament, it is sent to the President for approval. The President has the option to either -

  • approve the Bill
  • turning it into law or 
  • refuse approval

The President is also empowered with the authority to return a Bill (excluding Money Bills) to Parliament along with recommendations for reconsideration. If the Bill is re-approved by both Houses either with or without modifications the President is required to give approval.

Conclusion

Article 111 of the Indian Constitution empowers the President to either approve or withhold assent to a Bill passed by Parliament. The President can also return bills which are not Money Bill with recommendations for reconsideration. The President must grant assent if the Bill is passed again by both Houses. The provision ensures the legislative decision is upheld.
